The Assembly of Gambia Muslim Youths (AGAMY) strongly condemns the statements of the European Union Representative to the Gambia on the campaign and promotion of LGBT in the Gambia in a televised interview with Eye Africa TV.
AGAMY in its affirmative condemnation of the statements reminds the EU that the promotion of any unnatural activities does not only conflict with our norms, values and religion but attacks the constitutional provisions which frown at such activities since the colonial era. The following are several criminalization provisions which we want to remind the EU about.
Criminal Code 1934, Section 144 Unnatural Offences
Section 144 criminalizes carnal knowledge “against the order of nature” with a penalty of up to 14 years imprisonment. Sexual acts are criminalizes both between men and between women under this provision.
Criminal Code 1934, Section 147(1) Indecent practices between males:
Section 147(1) criminalizes acts of “gross indecency” between males, defined as “any homosexual act”, or the procurement or attempted procurement thereof, with a penalty of five years imprisonment.
Criminal Code 1934, Section 167 Rogues and Vagabonds:
Section 167, following amendment in 2013, criminalizes any man who dresses in the fashion of a woman in a public place with a penalty of up to five years imprisonment and a possible fine.
Criminal Code 1934, Section 147(2) Indecent practices between females
Section 147(2), introduced through the Criminal Code (Amendment) Act 2005, criminalizes acts of “gross indecency” between females, defined as “any homosexual act”, or the procurement or attempted procurement thereof, with a penalty of five years imprisonment.
The above provisions show the unwavering stance of Gambians against LGBT and its related activities and are the direct reflections of majority Gambians on the topic.
We would finally caution the EU not to go beyond frontiers again in issues of national discourse. It is the Gambians who can decide the kind of lifestyle they desire.
