The Supreme Court of The Gambia has on Wednesday 27th January 2020 ruled that former junta member of the AFPRC Yankuba Toura, lacks constitutional immunity. Reading the ruling on behalf of the Supreme Court, Chief Justice Hassan B Jallow said the court finds and holds that Mr Touray is not entitled to constitutional immunity for the alleged murder of Ousman Koro Ceesay pursuant to paragraph 13 (1), (3), (4), and (5) of the schedule of the constitution of the Republic of The Gambia 1994.
Chief Justice Jallow directed the High Court presented by Judge Ebrima Jaiteh to proceed with the case, adding that the reason for the ruling will be delivered by the court in due course.
It could be recalled that the defense counselor of the Mr Touray made an oral application for the High Court to discharge his client on the basis that as a member of the APFCR and pursuant to 13 (1), (3), (4), and (5) of the schedule of the constitution of the Republic of The Gambia 1994 he has immunity against prosecution. After hearing the submission the High Court referred the matter to the Supreme Court to rule on the matter.
